How does the IBI work in the buying and selling of a property?

The Property Tax (IBI) is a local tax that levies ownership of real estate in Spain. This tax is due on January 1st of each year, which means that the registered owner on that date is the legal responsible for its payment throughout the year.

In the context of a sale, although the law establishes that the seller (owner as of January 1st) must assume the payment of the IBI, it is common for the parties to reach agreements to share it proportionally according to the months each one has been the owner. This agreement should be formalized in writing, preferably in the sales deed, to avoid future conflicts.

If the IBI bill has already been paid by the seller before the sale, the proportional part corresponding to the buyer can be calculated and settled directly at the notary when signing the deed.
